The Competition Authority has issued a Guidance Note on pay-TV exclusivity providing helpful information to apartment residents and prospective apartment buyers. The Guidance Note
- details which categories of exclusivity agreements are unlikely to breach competition law;
- addresses specific issues raised by complaints and details what the Competition Authority is doing to help promote competition for the benefit of consumers of pay-TV; and,
- lists questions residents should ask to inform themselves of the feasibility of alternative service provision.
The Competition Authority also issued an enforcement decision (E/09/001) giving its view that, for the purposes of Irish and EC competition law, certain specified agreements between pay-TV service providers and developers for the provision of pay-TV service and infrastructure to apartment developments do not infringe competition law.
