On 25 June 1999, the Competition Authority invoked its powers under Section 11 of the Competition Act, 1991, as amended by the Competition (Amendment) Act, 1996, to undertake, on its own initiative, a study of the rail and bus passenger transport market. The study was intended to analyse the structural barriers affecting the rail and bus passenger transport market and was conducted according to the following terms of reference:
"To undertake a study and analysis of the licensing restrictions and other
barriers and restrictions to entry into the rail and bus passenger transport
market within the State, and their impact on delivery of passengers by intercity rail, intercity buses and urban buses."
