Competition Authority Announces Review of the Cartel Immunity Programme

15 July 2010

The Competition Authority has today called for submissions on a review of the Cartel Immunity Programme being conducted in conjunction with the Director of Public Prosecutions.

The Cartel Immunity Programme was first adopted by the Competition Authority and the Director of Public Prosecutions in 2001.  The programme outlines how a member of a cartel in Ireland may apply for immunity in return for its assistance in prosecuting other members of the cartel.

Having evaluated the way the Cartel Immunity Programme operates in practice and reflecting on international developments in the area of immunity and leniency, the Competition Authority and the Director of Public Prosecutions propose to make certain changes to the Cartel Immunity Programme.  These changes attempt to make the Cartel Immunity Programme more self-contained, transparent and attractive to potential applicants, therefore making it a more effective tool in the ongoing fight against cartels.

As part of the review, the Competition Authority has published a Consultation Paper that sets out in greater detail the changes to the Cartel Immunity Programme. The revised Cartel Immunity Programme and consultation paper are available here and interested parties are invited to make submissions on the review on or before Friday, 3 September 2010.
