Competition Authority Notices
Section 30(1)(d) of the Competition Act 2002 gives the Authority the function of publishing Notices containing practical guidance as to how the provisions of the Act may be complied with.
The purpose of a Notice is to give guidance to businesses and legal practitioners on the Authority’s views on how the Act applies in particular circumstances. Notices have no legal effect and are for guidance purposes only. It is ultimately a matter for the courts to decide whether or not a breach of the Act has occurred.
