The EU competition rules are contained in the
Treaty on the Functioning of the European Union
(“TFEU”). Articles 101 and 102 TFEU (ex Article 81 and 82 of the EU Treaty) prohibit the same kind of conduct as that prohibited by sections 4 and 5 of the Competition Act 2002.
